ONLINE DISPUTE RESOLUTION (ODR)
Since 15 February 2016 the European Commission's Online Dispute Resolution (ODR) platform has been in operation, allowing both consumers and traders to resolve their disputes online, whether those disputes concern domestic or cross-border transactions.
The ODR platform connects directly to the competent Alternative Dispute Resolution (ADR) bodies in each country, which handle the complaints. Each dispute resolution body applies its own rules and procedures. These are usually simpler, faster and less expensive than going to court. The choice of body must, however, be agreed by both contracting parties.
In Greece the competent bodies are:
A) the Independent Authority “Consumer’s Ombudsman”, and
B) the Hellenic Ombudsman for Banking and Investment Services.
The procedure takes place in four stages:
-- Submission of the complaint
-- Agreement on a dispute resolution body
-- Handling of the complaint by the dispute resolution body
-- Outcome and closure of the complaint
The procedure is straightforward, is completed online and covers every EU country. The body must reach a decision within 90 days.
The ODR platform falls within the framework of Directive 2013/11/EC, which was recently transposed into Greek law (by Joint Ministerial Decision 70330/2015) and provides for the online resolution of consumer disputes through the Alternative Dispute Resolution procedure throughout the EU.
