Right of withdrawal

Information concerning the Right of Withdrawal.

Customers who are consumers — that is, any natural person contracting at a distance who is not acting for purposes falling within their commercial, business, craft or liberal professional activity — are granted a right of withdrawal from distance contracts with GPScom Technologies on the following terms:

Exercising the right of withdrawal.

A.- The consumer customer's right of withdrawal from the contract with GPScom Technologies is exercised expressly, by an unequivocal statement and without giving reasons, that is, with no obligation to state any grounds for it.

B.- In the case of contracts for the sale of goods, the right of withdrawal expires fourteen (14) calendar days after the consumer customer, or any representative designated by them, acquires physical possession of the goods; or fourteen (14) calendar days after the conclusion of a contract for services.

C.- To exercise the right of withdrawal validly, the consumer customer may use either the model withdrawal form attached at the foot of this page or any other unequivocal statement of their decision to withdraw from the contract, and must address that statement, strictly within the above period of fourteen (14) calendar days, in particular by letter, fax or email, to:

Consequences of exercising the right of withdrawal.

Where the right of withdrawal is validly and timely exercised as set out above, the following consequences arise:

A.- The consumer customer must return the goods or services received to GPScom Technologies without undue delay and in any event within fourteen (14) calendar days of the date on which the withdrawal statement was sent. The deadline is met if the consumer customer returns the goods before that fourteen (14) day period expires. The consumer customer must also return every original document that accompanied the product (for example the dispatch note, the retail receipt, the warranty form and so on) together with its complete packaging.

B.- The consumer customer bears the ordinary cost of returning the goods to GPScom Technologies and carries the associated risk until they have been returned to GPScom Technologies.

C.- GPScom Technologies must refund every payment it received from the consumer customer, not including delivery costs.

D.- GPScom Technologies is entitled to withhold the refund of the price until it has received the goods back, or until the consumer customer supplies evidence of having sent the goods back, whichever happens first.

E.- If the consumer customer is unable to hand over or return the goods or services received to GPScom Technologies, in whole or in part, or returns or hands them over in a condition worse than their original condition, they are obliged to pay GPScom Technologies corresponding compensation, provided that the deterioration of the goods or services is attributable to handling beyond what was necessary to establish the nature, characteristics and functioning of the goods. “Establishing the nature, characteristics and functioning of the goods” means the examination and testing of the corresponding goods or service as would ordinarily be carried out in a physical shop.

b.- GPScom Technologies provided the prospective customer, before the contract was concluded, through its website or by any other appropriate means, with the necessary information on the interoperability of that particular product containing digital content with corresponding hardware and software, and on its general functionality.
